VISA TO CARE FOR MY GRANDCHILDREN

It is becoming increasingly common for people to look for ways to bring their parents to the UK. These cases can be delicate: people naturally feel strongly about being able to live close to their parents, but the UK Government is cautious about allowing elderly people to move here. Our client, an American woman, wanted to move to the UK to help care for the children of her German daughter who was living in the UK.

We submitted a visa application for our American client on the basis of her relationship with her daughter. The Government refused this initial application. We felt that the refusal had been unfair as the Government had ignored important evidence that we had submitted in support of our client’s application. As a result, we helped our client to appeal to the Tribunal against the Government’s decision.

While we were waiting for the appeal hearing at the Tribunal, we kept reviewing legal developments. When the Government introduced new immigration rules after Brexit, we saw that the new rules were more favourable for our American client.  Recognising this opportunity, we advised our client to submit a visa application under the new rules. She did so and a few weeks later the Government granted her the visa.

In effect, we had secured for our American client the result that she had wanted all along. She was over the moon!
